Common Law Separation


Common law spouses have unique issues that can be just as complex as those of married couples.


While common law couples are governed by the same or similar principles for parenting and support determinations after separation, in Ontario these couples do not have the same property rights and obligations as married couples. Unjust enrichment or other property claims may be available on a case by case basis.
